Terms & Conditions
Please read these Terms carefully. Section 15 contains a binding arbitration agreement and a class-action waiver. Unless you opt out as described in Section 15.4, you and Tradury LLC agree to resolve disputes through individual arbitration, and each of us gives up the right to sue in court and to have a jury decide the dispute.
1. Description of Service
1.1 General Overview. Tradury LLC, operating as The Tradury (“The Tradury,” “Tradury,” “we,” “us,” or “our”), provides an online educational platform and community covering stocks (including low-priced stocks), options, cryptocurrency, and foreign exchange (“forex”) markets (the “Service”). The Service may include, without limitation: (a) community servers, channels, and forums hosted on Discord, Whop, or similar platforms; (b) market commentary, watchlists, heatmaps, economic and dividend calendars, automated news feeds, charting, options-flow analysis, and analyst trade reflections; (c) live sessions, written publications, courses, research tools, and other learning resources; (d) one-on-one coaching, where offered; and (e) the website at tradury.com.
1.2 Educational Purpose. The Service and all content are provided strictly for educational and informational purposes. Tradury does not provide personalized investment, financial, tax, or legal advice. Section 12 explains our registration status and what our content is and is not.
1.3 Scope of Access. The Service is intended solely for individual members for personal, non-commercial use. Redistribution, commercial exploitation, or resale of the Service or its content is prohibited without our prior written authorization.
1.4 Change of Operator. These Terms replace any terms, rules, or policies published for this community before Tradury LLC began operating it. Promises, prices, perks, or arrangements made by any prior operator are not obligations of Tradury LLC unless Tradury LLC confirms them to you in writing from the official channels in Section 19.10.
1.5 Right to Modify. We may modify, suspend, or discontinue any part of the Service at any time. Where a change materially reduces a paid offering you have already purchased, Section 16.2 applies.
2. Use of Service
2.1 Eligibility. By accessing or using the Service, you represent and warrant that you: (a) are at least eighteen (18) years of age; (b) have full legal capacity to enter into and be bound by these Terms; and (c) are not prohibited by law or prior restriction from using the Service.
2.2 Compliance. You agree to comply with all applicable federal, state, and local laws, including securities, commodities, anti-fraud, and anti-money-laundering laws and the rules of any broker, exchange, or platform you use.
2.3 Prohibited Conduct. You shall not: (a) send spam, promotions, or unauthorized solicitations; (b) introduce malicious code or harmful software; (c) use bots, scrapers, or other automated means to access or copy the Service; (d) harass, threaten, defame, or abuse members or staff; (e) post unlawful, obscene, discriminatory, or objectionable content; (f) collect or disclose other members’ personal information without consent; (g) engage in or promote securities fraud, insider trading, market manipulation, or “pump-and-dump” activity, including coordinated buying or selling intended to move a price; (h) promote any security, digital asset, or token for undisclosed compensation; (i) solicit members for paid signals, account management, “investment opportunities,” recovery services, or off-platform payments; (j) impersonate Tradury staff or represent yourself as acting for Tradury; or (k) disrupt or interfere with the Service or its infrastructure.
2.4 Consequences of Violation. A violation of this Section is grounds for immediate suspension or termination of access. We may also report conduct to the platform involved or to law enforcement and pursue any remedy available by law.
3. Electronic Records and Member Acceptance
3.1 Electronic Acceptance. You accept these Terms by completing a Whop checkout or sign-up that references them, by selecting a checkbox or button that states you accept them, or by reacting to the designated Terms message in The Tradury’s Discord server. You consent to transact electronically, and your acceptance is a legally binding electronic signature under the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.) and the New Jersey Uniform Electronic Transactions Act (N.J.S.A. 12A:12-1 et seq.).
3.2 Paper Copies and Withdrawal. You may request a paper copy of these Terms at no charge by emailing hello@tradury.com. You may withdraw consent to electronic records by email; withdrawal ends your access to the Service.
3.3 Updates to These Terms. We will give at least fourteen (14) days’ notice of material changes through Discord announcements, email, or our website before they take effect. Continued use after the effective date is acceptance of the revised Terms. A revision does not apply to a dispute for which a Notice of Dispute was delivered before the revision took effect.
4. Intellectual Property Rights
4.1 Ownership. All content and materials provided through the Service, including written materials, videos, graphics, watchlists, educational resources, software, and the names, logos, and designs of Tradury (collectively, “IP Content”), are the property of Tradury LLC or its licensors. “The Tradury,” “Tradury,” the column “T” mark, and the Tradury wordmark are trademarks of Tradury LLC.
4.2 License Grant. Subject to these Terms, Tradury grants you a limited, revocable, non-exclusive, non-transferable license to access and use IP Content for personal, educational, non-commercial purposes.
4.3 Restrictions. You shall not: (a) reproduce, distribute, or publicly display IP Content without prior written authorization; (b) sell, sublicense, or commercially exploit IP Content; (c) reverse engineer or modify any software associated with the Service; or (d) remove or alter proprietary notices.
4.4 Reservation of Rights. All rights not expressly granted are reserved by Tradury LLC and its licensors.
5. Payments, Subscriptions, and Coaching
5.1 Free Access. As of the date of these Terms, access to The Tradury community is provided free of charge. Members pay no fee for community content, market commentary, watchlists, or analyst trade reflections.
5.2 Paid Offerings. Tradury may offer paid products such as coaching, courses, digital products, or memberships. Paid offerings are sold through our third-party membership platform (currently Whop) at the price, billing frequency, renewal terms, and cancellation terms disclosed to you before checkout.
5.3 Consent to Recurring Charges. Consistent with the Restore Online Shoppers’ Confidence Act (15 U.S.C. §§ 8401–8405), we will clearly disclose the material terms of any recurring charge before collecting billing information, obtain your express informed consent before charging you, and provide a simple way to cancel.
5.4 Renewal Reminders. For plans billed annually, we will send a reminder no fewer than fifteen (15) and no more than forty-five (45) days before each renewal, stating the renewal date, the amount, and how to cancel.
5.5 Confirmation. After each purchase you will receive a confirmation that summarizes the key terms, how to cancel, and how to reach us.
5.6 Refunds. Refunds are governed by the Tradury LLC Refund & Cancellation Policy, which is incorporated into these Terms. In summary, all sales are final except where the law requires a refund or where the Managing Member of Tradury LLC authorizes a refund in writing sent to you individually from hello@tradury.com. No other person has authority to promise or approve a refund, and no statement in any Discord server, direct message, or social-media message counts as authorization. Tradury never requests payment or offers refunds by direct message.
5.7 Coaching Sessions. Coaching is scheduled by appointment. You may reschedule a session without charge by giving at least twenty-four (24) hours’ notice. A session missed, or canceled with less than twenty-four (24) hours’ notice, is forfeited. If Tradury cancels a session, you may reschedule it or receive a refund for that session. Coaching is educational and is subject to Section 12.4.
5.8 Third-Party Platform. Purchases made through Whop are also subject to Whop’s terms of service and privacy policy. Whop processes payments; Tradury does not receive or store your full payment card details.
5.9 Taxes. Applicable sales and use taxes are calculated and collected at checkout through Whop where required.
6. Affiliate, Partner, and Sponsored Content
6.1 Compensation from Third Parties. Tradury may receive compensation from third parties, such as referral or affiliate commissions or partnership fees, including from trading platforms, brokers, data providers, or tool providers that we mention or link to.
6.2 Disclosure. When content involves a material connection, we will disclose it clearly and conspicuously in that content, consistent with the Federal Trade Commission’s Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 C.F.R. Part 255).
6.3 Member Referrals. If you share a Tradury referral or affiliate link and can earn anything for doing so, you must disclose that in the same post.
7. Confidentiality
7.1 Obligation of Confidentiality. You agree to keep confidential all non-public information obtained through the Service, including paid or members-only content, educational methodologies, and private community discussions.
7.2 Non-Disclosure. You shall not disclose, share, reproduce, or distribute confidential information in any form without our prior written consent.
7.3 Survival. These obligations survive termination of your access to the Service.
8. Privacy and Data
8.1 Privacy Policy. The Tradury LLC Privacy Policy governs how we collect, use, retain, and disclose personal information and is incorporated into these Terms.
8.2 No Sale of Data. Tradury does not sell or rent personal information.
8.3 Age Restrictions. The Service is not intended for anyone under eighteen (18). We do not knowingly collect information from children under thirteen (13), consistent with the Children’s Online Privacy Protection Act.
9. Disclaimer of Warranties
9.1 Service Provided “As Is”. The Service and all content are provided on an “AS IS” and “AS AVAILABLE” basis.
9.2 No Representations. To the fullest extent permitted by law, Tradury disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy, timeliness, or completeness of content, and any warranty that the Service will be uninterrupted, secure, or error-free.
9.3 User Responsibility. Reliance on any content or information obtained through the Service is at your own risk.
10. Limitation of Liability
10.1 Exclusion of Damages. To the maximum extent permitted by law, Tradury LLC and its members, managers, employees, analysts, moderators, agents, and affiliates shall not be liable for indirect, incidental, consequential, punitive, exemplary, or special damages, including lost profits, lost opportunities, or trading losses.
10.2 Liability Cap. To the maximum extent permitted by law, Tradury’s total liability for all claims relating to the Service shall not exceed the amount you paid Tradury for the Service during the twelve (12) months before the claim arose, or one hundred dollars ($100) if you paid nothing.
10.3 New Jersey Consumers. Nothing in these Terms limits any right you have under New Jersey law that cannot be waived by contract, including rights under the New Jersey Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.). The exclusions and limits in Sections 9, 10, and 11 do not apply to liability arising from Tradury’s fraud, gross negligence, or willful misconduct, or to the extent New Jersey law prohibits them.
11. Indemnification
11.1 User Indemnity. To the extent permitted by law, you agree to indemnify and hold harmless Tradury LLC and its members, managers, employees, analysts, moderators, and agents from claims, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your misuse of the Service; (b) your breach of these Terms; or (c) your violation of law or of a third party’s rights. This Section does not apply to claims caused by Tradury’s own negligence or misconduct.
11.2 Control of Defense. Tradury may assume control of the defense of any matter subject to indemnification, and you agree to cooperate.
12. Registration Status and Investment Disclaimers
12.1 Registration Status. Tradury LLC is not registered as an investment adviser with the U.S. Securities and Exchange Commission or the New Jersey Bureau of Securities, is not a broker-dealer, and is not registered with the Commodity Futures Trading Commission or the National Futures Association as a commodity trading advisor, commodity pool operator, or retail foreign exchange dealer.
12.2 Impersonal, General Content. Community content is general, is directed to all members at once, and is not tailored to any person’s finances, objectives, or risk tolerance. It is not a solicitation or a recommendation to buy, sell, or hold any security, digital asset, or currency.
12.3 Analysts and Moderators. Analysts and moderators share their own views for educational purposes. They are not licensed financial professionals unless a post states otherwise. Analysts may share trade ideas, including entry, exit, and invalidation levels from their own analysis; these illustrate a process and are not instructions to trade. Content posted by members represents personal opinion only.
12.4 Coaching. Coaching addresses process: trade planning, risk management, journaling, review, and discipline. Coaching does not include recommendations to buy or sell any specific security, digital asset, or currency pair; management of, access to, or discretion over your accounts; or trading on your behalf. Every decision in your account is yours.
12.5 Independent Responsibility. You are solely responsible for evaluating any investment or strategy and for every trading decision you make. You are encouraged to consult licensed financial, tax, and legal professionals.
12.6 Past and Hypothetical Performance. Any reference to past, simulated, or hypothetical performance is for illustration only and does not guarantee future results. Section 18 and the Tradury LLC Risk Disclosure describe the risks of trading.
13. User Content and DMCA
13.1 License to Tradury. By posting content within the Service, you grant Tradury a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that content within the Service. Tradury will use your testimonial or comments in marketing only with your separate written consent and the attribution you approve.
13.2 DMCA. Copyright notices may be sent to hello@tradury.com. A valid notice must identify the copyrighted work and the infringing material, include your contact information, and contain a good-faith statement and a statement under penalty of perjury as required by 17 U.S.C. § 512(c)(3). Counter-notices must comply with 17 U.S.C. § 512(g).
13.3 Community Standards. Tradury may remove content or restrict participation for violations of these Terms or the community rules.
14. Termination and Suspension
14.1 Right to Terminate. Tradury may suspend, restrict, or terminate access to the Service, in whole or in part, for any violation of these Terms or where reasonably necessary to protect members, staff, or the Service.
14.2 Effect of Termination. Upon termination, your license to the Service ends and you must delete any Tradury materials in your possession.
14.3 Refunds on Termination. Termination for a violation of these Terms does not entitle you to a refund except where required by law. If Tradury terminates your access for any other reason, you will receive a refund of any prepaid, unused portion of a paid offering.
15. Governing Law and Dispute Resolution
15.1 Governing Law. These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs Section 15.3.
15.2 Informal Resolution First. Before starting arbitration or a court proceeding (other than small claims under Section 15.6), the party raising a dispute must send the other a written Notice of Dispute. Notices to Tradury must be sent by email to hello@tradury.com with the subject line “Notice of Dispute.” The notice must be signed by the person raising it and state the person’s name, the Whop username and email on the membership (if any), the facts, the amount in controversy, and the relief requested. The parties will try in good faith to resolve the dispute for sixty (60) days after the notice is received; any limitations period is paused during that time.
15.3 Binding Arbitration and Waiver of Court and Jury. If a dispute is not resolved under Section 15.2, you and Tradury agree that it will be decided by a neutral arbitrator, not by a judge or jury in court. You and Tradury each waive the right to file a lawsuit in court and the right to a jury trial for any dispute arising out of or relating to these Terms or the Service. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Burlington County, New Jersey, unless those rules require a location more convenient to you. Fees are allocated as the AAA consumer fee schedule provides. Arbitration involves more limited discovery and appeal rights than court.
15.4 Opt-Out Right. You may opt out of Section 15.3 by emailing hello@tradury.com with your name and the subject line “Arbitration Opt-Out” within thirty (30) days after you first accept these Terms. Opting out does not affect any other part of these Terms.
15.5 No Class or Collective Actions. Disputes will be resolved on an individual basis only. You and Tradury each waive the right to bring or participate in a class, collective, consolidated, or representative action. If this Section is found unenforceable as to a claim, that claim will proceed in the state or federal courts located in Burlington County, New Jersey, after all arbitrable claims are resolved.
15.6 Small Claims Exception. Either party may bring an individual claim in small claims court within that court’s jurisdiction.
15.7 Equitable Relief. Tradury may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
15.8 International Users. The Service is operated from the United States and offered in English. Nothing in these Terms limits any mandatory consumer right under the law of your country of residence, including any statutory right of withdrawal. You are responsible for ensuring your use of the Service is lawful where you live.
16. Modifications to Service
16.1 Notice of Changes. We will announce material changes to the Service through Discord announcements, email, or our website.
16.2 Paid Offerings. If we discontinue or materially reduce a paid offering before the end of a period you have paid for, you may cancel and receive a refund of the prepaid, unused portion.
17. Data, Content, and Information Disclaimers
17.1 Informational Use Only. All data, commentary, trade examples, and resources are for informational and educational purposes.
17.2 Third-Party Data. Market data, heatmaps, calendars, and automated news may come from third parties and may be delayed, incomplete, or inaccurate. Verify information independently before relying on it.
17.3 Community Content. Channels may contain user-generated content that Tradury does not control or endorse.
18. Investment Risk
18.1 High Risk of Loss. Trading stocks, low-priced stocks, options, cryptocurrency, and forex involves substantial risk and is not suitable for everyone. You can lose some or all of the money you trade, and with leveraged or short positions you can lose more than you deposit.
18.2 No Guarantee. Tradury makes no guarantee of profit or of any particular outcome.
18.3 Hypothetical Results. Hypothetical or simulated results have inherent limitations, do not represent actual trading, and do not reflect the impact of liquidity, slippage, fees, or emotion. No representation is made that any account will achieve results similar to those shown.
18.4 Risk Disclosure. The Tradury LLC Risk Disclosure describes market-specific risks and is incorporated into these Terms.
19. General Terms
19.1 Activities of Personnel. Tradury personnel may trade for their own accounts, including in instruments discussed in the Service,, which creates a potential conflict of interest. Personnel are not required to disclose their positions.
19.2 Force Majeure. Tradury is not liable for delays or failures caused by events beyond its reasonable control, including platform outages (such as Discord or Whop), acts of government, or changes in law.
19.3 Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect.
19.4 Headings. Headings are for convenience only.
19.5 Entire Agreement. These Terms, the Privacy Policy, the Refund & Cancellation Policy, and the Risk Disclosure are the entire agreement between you and Tradury regarding the Service.
19.6 Assignment. You may not assign these Terms without our written consent. Tradury may assign them in connection with a merger, acquisition, or sale of assets.
19.7 Survival. Sections 4, 7, 9, 10, 11, 12, 15, and 19 survive termination.
19.8 Sanctions. You represent that you are not located in, or a person subject to, any U.S. sanctions program administered by the Office of Foreign Assets Control.
19.9 Recordings. Live sessions may be recorded. Tradury will announce a recording at the start of a session, and you may participate with your camera and microphone off.
19.10 Notices and Official Channels. Legal notices to Tradury must be sent to hello@tradury.com. Official communications from Tradury come only from hello@tradury.com or announcements in official Discord channels by verified staff. Tradury does not send payment instructions or refund offers by direct message.
